1. Acceptance of Terms
By accessing or using FormsToDB ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users of the Service.
2. Description of Service
FormsToDB is a software-as-a-service (SaaS) platform that allows users to connect HTML forms to a lead management dashboard. The Service includes form endpoint creation, lead capture, lead management, analytics, notifications, and related features.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 16 years of age to use the Service
- One person or entity may not maintain more than one free account
- You are responsible for all activity that occurs under your account
4. Subscription Plans and Billing
4.1 Paid Plans
FormsToDB offers Free and paid subscription plans. Paid plans are billed monthly or annually as described on our pricing page. Prices are subject to change with 30 days notice.
4.2 Add-ons
Certain features (Form Builder, Lead Analytics) are available as one-time purchases providing lifetime access. These are non-refundable once the feature has been accessed.
4.3 Free Plan Limits
Free plans are subject to submission limits and feature restrictions as described at formstodb.com/pricing. We reserve the right to modify free plan limits with reasonable notice.
4.4 Cancellation and Refunds
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for unused subscription time. Exceptions may be made at our sole discretion for genuine billing errors.
5. Acceptable Use
You agree not to use FormsToDB to:
- Collect data without proper consent from your form visitors
- Send spam, unsolicited emails, or engage in illegal marketing practices
- Process data of minors without verifiable parental consent
- Engage in phishing, fraud, or deceptive practices
- Attempt to circumvent any security measures or access controls
- Overload our systems or interfere with service availability
- Resell or sublicense the Service without written authorization
- Store sensitive personal data such as social security numbers, payment card numbers, or medical records
6. Data Ownership and Responsibility
You retain ownership of all lead data collected through your forms. By using the Service, you represent that you have the legal right to collect and process this data and that you have provided appropriate privacy notices to your form visitors.
You are responsible for complying with all applicable data protection laws including GDPR, CCPA, and any other regulations applicable to your location and the location of your form visitors.
7. Intellectual Property
The FormsToDB platform, including its software, design, and content, is the exclusive property of FormsToDB and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
You retain all rights to your own content and lead data.
8. Service Availability and Uptime
We strive for high availability but do not guarantee 100% uptime. We may perform maintenance that temporarily interrupts the Service, with advance notice when reasonably possible. We are not liable for losses resulting from service interruptions.
9. Limitation of Liability
To the maximum extent permitted by law, FormsToDB and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components.
11. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent or abusive behavior, or for any other reason with reasonable notice. Upon termination, your access to the Service ceases and your data may be deleted after 30 days.
12. Governing Law
These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.
13. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email. Continued use of the Service after changes become effective constitutes acceptance.
